ORDER

This Writ Petition is filed seeking to issue a to issue a Writ of Mandamus directing the 1st respondent to consider the petitioner's representation dated 31.03.2023 to provide any Depressed Class (DC) Lands or the land in Survey No.126/1 to an extent of 4.72 acres and 129/4 to an extent of 0.38 acres, reserved for Scheduled Caste, situated in Pilparuthi Revenue Village, Pappireddipatti Taluk, Dharmapuri District, based on the order of the 2nd respondent in Na.Ka.No.1573/2022/A2 dated 13.04.2023, with the time as may be fixed by this Court.

2. When the matter came up before this Court on 18.03.2024, in order to ascertain as to whether the 1st respondent/Tahsildar has passed orders based on the directions of the 2nd respondent/RDO, this Court had directed the 1st respondent/Tahsildar to appear before this Court on 20.03.2024.

3. Today (20.03.2024), when the matter is taken up for hearing, the 1st respondent namely Mr.R.Saravanan, Tahsildar, Pappireddipatty, Dharmapuri District appeared before this Court.

4. The learned Additional Government Pleader appearing for the respondents admitted that so far no final order is passed. However, he 2/5

would submit that, notice has been issued to the petitioner to appear for enquiry which is scheduled to be held on 27.03.2024.

5. In view of the submission made by the learned Additional Government Pleader, the petitioner is directed to appear before the 1st respondent/Tahsildar on 27.03.2024 and make all his submissions. The 1st respondent/Tahsildar is directed to conduct enquiry in the manner known to law after giving opportunity of hearing to the petitioner and interested parties/rival claimants/aggrieved parties/objections if any, as the case may be and pass orders on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs.

7. The appearance of the 1st respondent/Tahsildar is dispensed with. 20.03.2024 Index : Yes / No Speaking Order : Yes / No ksa-2 Note: Issue order copy on 20.03.2024.
