Mr.V.Vasantha Kumar, AGP for R1 to R5 No appearance for R6 & R7 Order This Writ Petition has been filed challenging the impugned order of the fifth respondent requesting the sixth respondent to furnish the performance guarantee by the impugned order dated 07.03.2022.
2. Now, when the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 5, after taking instructions, informed the Court that subsequent to the issuance of the said impugned notice, the performance guarantee was furnished and work has also been executed. Therefore, the prayer sought in the Writ Petition has become infructuous as there is no scope for passing the said impugned notice and thereafter, issued a fresh tender.
3. In such view of the matter, recording the above submission of the learned Additional Government Pleader for the respondents 1 to 5, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
