PRAYER: Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to settle the retirement benefits payable to the petitioner as on the date of retirement on 31.5.2024 without reference to section 82 inspection as per the proceedings of 3rd respondent in Na.Ka.No.2353/2025 /Pasa1 dated 11.8.2025 signed on 22.10.2025 along with interest at the rate of 12 percentage pa for delay in settlement of retirement benefits from the date of retirement on 31.5.2024 as well as the interest on payment of Employees Provident Fund (EPF) sanctioned to the petitioner by considering the representation lastly submitted by the petitioner dated 4.2.2026 within a time frame For Petitioner(s):

ORDER

The petition has been filed directing the respondents to settle the retirement benefits payable to the petitioner as on the date of retirement on 31.5.2024 without reference to section 82 inspection as per the proceedings of 3rd respondent in Na.Ka.No.2353/2025 /Pasa1 dated 11.8.2025 signed on 22.10.2025 along with interest at the rate of 12 percentage pa for delay in settlement of retirement benefits from the date of retirement on 31.5.2024 as well as the interest on payment of Employees Provident Fund (EPF) sanctioned to the petitioner by considering the representation lastly submitted by the petitioner dated 4.2.2026 within a time frame.

It is the case of the petitioner that the petitioner was intially appointed as Junior Assistant in the 4th respondent society on 13.10.1986 and was sanctioned Selection Grade after completion of ten years of service. Pursuant to the Government orders, the petitioner was granted Selection Grade and Special Grade on notional basis with monetary benefits from 21.08.2007. Thereafter, he was promoted as Accountant, subsequently, promoted as Secretary and attained superannuation on 31.05.2024.

3. The petitioner would further submit that the full retirement benefits was not paid to him. Despite several representations, the balance amounts towards Gratuity, Surrender Leave salary and PF/EPF were not settled. Subsequently, an inspection under Section 82 of the Co-operative Societies Act was initiated against the petitioner after his retirement, as a result of which, his retirement benefits are withheld. Aggrieved by the same, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the third respondent to consider the petitioner's representation dated 04.02.2026, on

merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the writ petition is disposed of. No costs. 03-03-2026 Index: Yes/No Speaking/Non-speaking order ssa
