Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the second respondent to conclude and pass orders within a stipulated period on the petitioner's appeal dated 31.07.2018 submitted against the issuance of separate patta by subdividing the land in S.No.460/2 of Annur Village, issued by Annur Tahsildar, the 3rd respondent herein.

ORDER

The present petition is filed seeking a direction to the second respondent to conclude and pass orders in the appeal preferred by the petitioner on 31.07.2018, challenging the proceedings of the Tahsildar, Annur Taluk in R.T.R.No.2017/12/11/000039SD dated 21.08.2017.

2. Heard the learned counsel for the petitioner. Mr.S.N.Parthasarathi, learned Government Advocate takes notice for respondents 1 to 3. He made a statement on instructions https://hcservices.ecourts.gov.in/hcservices/

that an enquiry was to take place in June ' 2020, but further proceedings could not be conducted due to onset of COVID-19, and national lock down announced. He also added that the Revenue Divisional Officer is engaged with certain responsibilities associated with the General Election-2021 for the State Legislative Assembly. He further submitted that an enquiry in this matter will continue, and it is now scheduled to take place at 3.00 p.m., on 17.05.2021 in the office of the Revenue Divisional Officer, Covai North, Coimbatore. The said statement is recorded.

3. In view of the above, no further direction is required to be given except that the District Revenue Officer, Covai North, Coimbatore is now directed to hold an enquiry after issuing notices to all the parties who are likely to be affected by his decision, and after providing the parties a fair and effective hearing and to dispose of the matter through a speaking order within a period of twelve (12) weeks from 17.05.2021.
