Sub Application filed Under Section 151 of the Code of Civil Procedure praying this Court be pleased to direct the Respondents to dispense with the personal appearance of the Petitioner/Respondent before this Hon'ble Court on 31.03.2022 in the above Contempt Petition. The above Sub Application and Contempt Petition coming on this day before this Court for hearing in the presence of Mr.P.Kumaresan, Learned Additional Advocate General-VII Assisted by Mr.S.Ravichandran, Additional Government Pleader for the Petitioner herein; and of Ms.R.Hemalatha, Learned Counsel for Mr.C.Prakasam, appearing for the Respondent herein; and upon perusing the Application and affidavit of
B.Murugesh, filed herewith; the Court made the following order:- "This Sub Application has been filed to dispense with the personal or physical appearance of the respondent, who was directed to appear before this Court by issuing statutory notice by the order of this Court dated 31.03.2022.
2. Supporting this application, Mr.P.Kumaresan, learned Additional Advocate General appearing for the petitioner, who was the respondent in the main Contempt Petition submitted that, due to the reasons stated in the affidavit, the officials concerned, who are directed to appear before this Court, could not appear before this Court.
3. He would further submit that, in order to comply with the orders passed by this Court dated 26.07.2021 made in W.P.No.23566 of 2017, private negotiation went on, pursuant to which, the compensation for land acquired from the petitioner was fixed at Rs.1,13,54,226/-. Having agreed to the same, the petitioner also signed it and a document to that effect has also been produced before this Court. In view of these developments, where the issue being amicably settled, this petition for dispense with may be considered, he contended.
4. Considering the submissions made by the learned Additional Advocate General and having gone through the reasons stated in the affidavit, this Court is inclined to accept this petition. Accordingly, the sub application is ordered."
