Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the respondents, especially the second respondent relating to his proceeding made in Letter No.11130/OP1-2/ 2011-1 dated 15.06.2011 and quash the same and consequently directing the respondents for the upgradation and stepping up of the petitioner's pay scale in the cadre of Joint Secretary to Government with effect from 22.12.2010 on par with her Junior Thiru M.E.Manoharan attached to Finance Department and grant all monetary benefits by issuing paper order to that effect.

This Writ Petition has been filed questioning the Proceedings in Letter No.11130/OP1-2/ 2011-1 dated 15.06.2011, wherein the request of the petitioner for upgradation and stepping up of his pay on par with his Junior working in the Finance Department was negatived by the respondents.
2. When the matter is taken up for consideration, it is brought to the notice of this Court by the learned counsel for the petitioner that under similar circumstances, this Court directed consideration of the cases of similarly situated persons in W.P.No.2710 of 2014 and W.P.No.15072 of 2014 by orders dated 08.06.2022 and 14.06.2022 respectively.
3. According to the learned counsel for the petitioner, the case of the petitioner in the said Writ Petition is under active consideration before the
respondents and prays for directing the respondents to reconsider the case of the petitioner on par with the petitioners in the above referred two Writ Petitions. The learned counsel appearing for the respondent reported no objection for such course of action.
4. In the circumstances, the petitioner is granted liberty to submit a representation before the respondents for consideration of his case for grant of upgradation and stepping up of his pay on par with the persons working in Finance Unit and in case any such representation is made within a period of two weeks from the date of receipt of a copy of this order, the same shall be considered by the respondents along with the cases of Mr.R.Radhakrishnan and M/s.M.R.Geetha, who are the petitioners in W.P.No.2710 of 2014 and W.P.No.15072 of 2014 and pass appropriate orders thereon in accordance with law.
5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions, if any, shall stand closed. 14.12.2023 skr
