ORDER

This writ petition has been filed to direct the fourth respondent to record the receipts, morefully disclosed in the prayer to this writ petition and thereafter to remove the encumbrance of mortgage/MOD bearing document No.7407/2007 dated 16.07.2007 and document No.9666/2010 dated 15.03.2010 respectively registered on the file of the District Registrar, Tirupur District, based on the petitioner's representation dated 08.01.2026, within a time frame to be fixed by this Court.

2.The petitioner claims that he had earlier borrowed loan from the State Bank of India by executing the memorandum of deposit of title deeds registered as document No.7407/2007 dated 16.07.2007 and document No.9666/2010 dated 15.03.2010. The petitioner claims that they have now discharged the entire loan payable to the State Bank of India under the aforesaid memorandum of deposit of title deeds. According to the petitioner, the property is mortgaged by them under the jurisdiction of the District Registrar, Tirupur. According to the petitioner, in respect of the properties falling under the jurisdiction of two

District Registrars, based on the discharge of the mortgage, encumbrances have been removed.

3.According to the petitioner, in respect of the properties falling under SRO, Palladam, Tirunelveli District, the receipts submitted by the petitioner have not been registered and the encumbrances are yet to be removed. According to the petitioner, the property falls under the jurisdiction of District Registrar, Tiruppur. The petitioner had given a representation on 08.01.2026 requesting the respondents to register the receipts and remove the encumbrance. Since the same has not been considered, the petitioner has filed this writ petition.

4.Mr.P.Harish, learned Government Advocate accepts notice on behalf of the respondents.

5.No prejudice would be caused to the respondents if the petitioner's representation as stated supra, is considered on merits and in accordance with law, after giving due consideration to the supporting documents, produced by the petitioner, within a time frame to be fixed by this Court.

6.This Court is not expressing any opinion on the merits of the petitioner's representation.

7.For the foregoing reasons, this writ petition is disposed of by directing the fourth respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 08.01.2026 requesting the fourth respondent to register the receipts, morefully disclosed in the prayer to this writ petition and thereafter remove the encumbrance of mortgage/MOD bearing No.7407/2007 dated 16.07.2007 and document No.9666/2010 dated 15.03.2010, within a period of four weeks from the date of receipt of a copy of this order. No costs.
