The application in A.No.1574 of 2023 has been filed by the applicant/third defendant, seeking to condone the delay of 52 days in filing the Written Statement.

2. In the affidavit filed in support of the condone delay petition it is stated that the suit summons was served on the applicant just prior to the closure of the Court for December vacation. The written statement was filed by the third defendant after perusing all the relevant documents and the said process was completed only in February. This petition was not seriously opposed by the learned counsel for the respondents.

3. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, this application in A.No.1574 of 2023 is allowed.
