Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus forbearing the respondent 1 to 3 from merging the Drug Control administration with Food Control by forming new Commissionerate under the Food Safety and Standards Act, 2006 empowering to enforce the Drugs and Cosmetics Act, 1940 and Rules, 1945 and Drugs and Magic Remedies (Objectionable advertisement) Act, 1954 contrary to the provisions of the Central Acts.

ORDER

(Order of the Court was made by The Hon'ble Chief Justice) In view of the Notification having been published by the State Government subsequent to the filing of the writ petition, the learned counsel for the petitioner seeks to withdraw the writ petition and states that if the petitioner is interested, he would assail the statutory provision in accordance with law.
