Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, for issuance of a writ of Mandamus directing the 2nd respondent to issue application form and sanction the education loan to the petitioner for studying B.sc (Nursing) Degree course in Vinayaka Mission's Annapoorna College of Nursing, Salem, consequently directing the 2nd respondent to disburse the loan amount as per the fees certificate issued by the 3rd respondent an accordance with law within the time stipulated by this Hon'ble Court.

OR D E R The relief sought for in this writ petition is for a direction to direct the 2nd respondent to issue application form and sanction the educational loan to the petitioner for studying B.sc (Nursing) degree course in Vinayaka Mission's Annapoorna College of Nursing, Salem and consequently direct the 2nd respondent to disburse the loan amount as per the fees in accordance with law.

2. The learned counsel appearing on behalf of the respondent bank made a submission that the writ petitioner has not even submitted the application form in the prescribed form. This apart, the writ petitioner has not secured the minimum marks required for the purpose of grant of educational loan as per the terms and conditions of the scheme.

3. This Court is of an opinion that, the writ petitioner has not even submitted the application and even in the relief sought for in the present writ petition, the writ petitioner states that the direction has to be issued to issue an application form.

4. This being the factum of the case, the writ petitioner shall download a copy of the application form from the respondent bank website and submit the filled application form along with the relevant documents to the respondent.

5. In the event of submitting any such application by the writ petitioner, the respondent shall consider the same and pass orders on merits and in accordance with law without causing any undue delay.

6. With these directions, the writ petition stands disposed of. There shall be no order as to costs.
