Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records of the first respondent with No.RC/2011/013 dated 09.05.2011 in respect of the vacancy notified in the faculty of Management under the OBC quota in the Pondicherry University Community College, Lawspet, Puducherry and to quash the same and consequently to direct the respondents to regularize the services of the petitioner in the post of Assistant Professor with effect from 01.09.2002, the date on which the petitioner was appointed on hourly paid basis with all other consequential benefits including difference of wages, seniority etc.,

O R D E R

This Writ Petition has been filed questioning the Notification No.RC/2011/013 dated 09.05.2011 issued by the 1st respondent, notifying the faculty of management under OBC quota in Pondicherry University Community College, Lawspet, Puducherry and sought for consequential direction to regularize the services of the petitioner in the post of Assistant Professor.

2. When the matter is taken up for consideration, it is brought to the notice of this Court by M/s. A.V.Bharathi, learned counsel appearing for the respondents that the post of Assistant Professor in question was already filled up in pursuant to the impugned notification and one M/s. A.Bharathi was appointed on 09.04.2012. But, the said M/s. A.Bharathi is not impleaded as a necessary party to the Writ Petition. In the absence of the beneficiary of the impugned notification being made as a party to the Writ Petition, no relief can be granted in this Writ Petition. Further, this Court does not find any substantial ground to interfere with the impugned notification issued by the respondents in any manner.
