ORDER
(Order of the Court was made by SATISH K. AGNIHOTRI, J.) Mr. P.S. Sivashanmugasundaram, learned Special Government Pleader, takes notice for the respondents. With the consent of the learned counsel for the parties, the writ petition is taken up for final disposal, at the admission stage itself. By this petition, the petitioner seeks a writ of mandamus directing the respondents to remove all the encroachments in the specified poramboke land situated in S.No. 26/7 at Sri Aadhivaraganallur Village, Kattumannarkoil Taluk, Cuddalore District. From a perusal of the materials available on record, it transpires that one C. Selladurai, filed a writ petition in W.P. No.684 of 2015, seeking a direction to the respondents to remove all the encroachments in the specified poramboke land situated in S.No.26/7 at Sri Aadhivaraganallur Village, Kattumannarkoil Taluk, Cuddalore District, which was dismissed as withdrawn, by order dated 12.01.2015. However, in the said order, an observation was made to the following effect:
"We, however, make it clear that this will not preclude the respondents, more specifically respondent No.4/Tahsildar to examine the representation dated 01.12.2014 made to the first respondent in terms of the G.O. (Ms.) No.540 dated 04.12.2014 dealt with in our order dated 11.08.2015 in W.P. No.26722 of 2013."
According to the learned counsel for the petitioner, despite clear observation made by this Court, as aforestated, no action has been taken by the authorities, till date. The instant writ petition also is preferred for the same direction by the present petitioner, who is seeking an identical redressal, as was considered by a Division Bench of this Court and disposed of.
Thus, it is not necessary to pass any order in the instant writ petition. However, it is expected that the authorities will take the observation made by us in W.P. No.684 of 2015 seriously and do the needful, as directed by this Court, within a period of four weeks from the date of receipt of a copy of this order.
The writ petition stands disposed of with the above observation. Costs made easy. Connected Miscellaneous Petition is closed.
