This Writ Petition has been filed forbearing the 4th respondent from the petitioner construction of house in survey No.557/A3 extent 0.00.5 cents and in survey No.557/A4 extent 0.46 cents total extent 46 1⁄2 cents at Itchiputtur, Sarasvathi Nagar, Arakkonam Taluk.
2. The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the property comprised in survey No.557/A3 to an extent of 0.00.5 cents and in survey No. 557/4A to an extent of 0.46 cents, totally 46 1⁄2 cents situated at Itchiputtur, Saravathi Nagar, Arakkonam Taluk. The petitioner tried to construct the house. The 4th respondent, without giving any notice, stopped the construction of the petitioner. Therefore, the petitioner made a representation dated 03.02.2022 before the respondents 1 to 3 with regard to the unauthorized prevention of the petitioner's construction. Even today, no order has been passed. Hence, the petitioner filed the present writ petition.
3. Though very many grounds have been raised, learned counsel for the petitioner submits that it would suffice if this Court issues a direction to the respondents not to interfere with his peaceful possession without following due process of law.
4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner will have no disturbance, as regards his possession and without following the due process of law, his possession will not be disturbed.
5. Recording the aforesaid submission, this Writ Petition is closed. Consequently, connected miscellaneous petition is closed. No costs.
