Respondent Criminal Original Petition has been filed under Section 482 of Cr.P.C seeking a direction to the trial Court viz., the Additional Sessions Court at Thiruvallur to expedite the trial in S.C.No.230 of 2015.

O R D E R

This Criminal Original Petition has been filed seeking a direction to the trial Court viz., the Additional Sessions Court, Thiruvallur to expedite the trial in S.C.No.230 of 2015.

2. Pursuant to the directions issued by this Court, the I Additional District & Sessions Judge, Thiruvallur, has sent a detailed report dated 24.04.2018, in which, it is stated that there are totally four accused in the case and one after other was absconding, when the I Additional District & Sessions Judge, Tiruvallur attempting to frame charge. The I Additional District & Sessions Judge, Tiruvallur has further stated as follows:

"I humbly submit that the delay in framing of charges was caused only due to the non appearance of all the accused in one day. Further, I submit that charges will be framed on 28.04.2018 if the police executed the NBW pending against A4.

I humbly submit that the Hon'ble High Court may kindly be pleased to consider the https://hcservices.ecourts.gov.in/hcservices/

above circumstances of the case for the delay caused. I also humbly assure that the trial will be expedited after framing of charges as per the directions of the Hon'ble High Court."

3. In view of the above, this Court directs the respondent police to expeditiously execute the non-bailable warrant issued against A4. If any accused abscond, a fresh FIR can be registered against them under Section 229-A IPC. The trial Court is directed to complete the trial in S.C.No.230 of 2015, within a period of six months, after A4 is secured. With the above directions, this petition is closed.
