This application has been filed seeking to permit the applicants / plaintiffs to file the written statement to the counter claim of the respondents / defendants by condoning the delay of 196 days.

2.In the affidavit filed in support of this application, it had been stated that the father of the applicants counsel was under treatment due to severe health complications and hence the applicants was not able to meet the counsel to give necessary instruction for filing of the written statement to the counter claim. Hence, there was a delay of 196 days in filing the same. The delay was neither willful nor wanton.

3.Taking into consideration the facts and circumstances of the case and also in the interest of justice, this Application is allowed. The written statement to the counter claim is taken on record.

4.List the suit in the normal course.
