(The case has been heard through video conference) The Writ Petition has been filed seeking a direction directing the respondent to consider the petitioner's representation date 26.02.2021 for fixing the boundaries and to effect subdivisions of the boundaries in the petitioner's land in R.S.No.1457/3, 1542/2, 1543/12, 1544/4,7,9 and 1545/1 situated at Thenmugam Vellode village, Perundurai Taluk, Erode District within the time fixed by this Court.
2. The grievance of the petitioner is that, the petitioner is the owner of the property to an extent of 2.48 acres of land along with a house in R.S.No.1457/3, 1542/2, 1543/12, 1544/4,7,9 and 1545/1 of Thenmugam Vellode village, Perundurai Taluk, Erode District. The petitioner's mother partitioned the property and based on that, the petitioner wanted to sub divide the property. https://hcservices.ecourts.gov.in/hcservices/
Subsequently, he has made an application to the respondent Tahsildar as early as on 26.02.2021. But, so far, his representation was not considered and no order has been passed on it. Hence, the present writ petition has been filed by the petitioner.
3. The learned counsel appearing for petitioner would submit that the petitioner's application is pending with the respondent for more than 4 months. Hence, the respondent may be directed to consider the petitioner's application and to pass suitable orders on merits.
4. Considering the limited prayer sought in the Writ Petition, without going into the merits of the case, the respondent is directed to consider the petitioner's application and to pass suitable orders on merits in accordance with law after hearing the petitioner and other interested persons in the property, within a period of twelve weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition stands disposed of. No costs.
