The Petitioner/Tamil Nadu State Apex Co-operative Bank Pensioners' Association has come up with the above Writ Petition seeking a direction to the respondents herein to ensure that the pensioners of the fourth respondent Bank are provided adequate dearness relief in the form of Dearness Allowance based on 12(3) Settlement in accordance with the Consumer Price Index (General), within a time fixed by this Court.

According to the petitioner/Association, though the fourth respondent/Bank has given effect to all other items covered under the 12(3) Settlement, the aspect of Dearness Allowance has been given a go-by, with the result that the pensioners of the fourth respondent/Bank are getting the same amount as pension for the past 25 years, while the price index has been spiraling through the years. In this regard, the petitioner/Association has addressed representations to the fourth respondent/Bank on 12.02.2024 and 22.02.2024 to ensure that the pensioners of the fourth respondent/Bank are provided adequate dearness relief in the form of Dearness Allowance based on 12(3) Settlement in accordance with the Consumer Price Index (General). As the said representations have not been considered so far, the petitioner/Association has come up with the above Writ Petition. 3.

Learned counsel for the petitioner submitted that it would suffice, if a direction is issued to the fourth respondent/Bank to consider the representations dated 12.02.2024 and 22.02.2024 sent by the petitioner/Association, and pass appropriate orders on merits and in accordance with law, within a specific period.

4. Learned Additional Government Pleader appearing for respondents 1 and 2 and the learned counsel appearing for respondents 3 and 4 have no objection to the same.

Considering the facts and circumstances of the case and also the limited request made by the learned counsel for the petitioner/Association, this Court, without going into the merits of the matter, directs the petitioner/Association to send a fresh representation to the fourth respondent/Bank along with a copy of their earlier representations dated 12.02.2024 and 22.02.2024, and a copy of this order, to the fourth respondent/Bank, within a period of two weeks from the date of receipt of a copy of this order and on receipt of the same, the fourth respondent/Bank is directed to consider the same and pass appropriate orders on merits and in accordance with law within a period of four weeks.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
