Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records pertaining to the Refusal Check Slip No.RFL/Vaniyambadi/153/2024, dated 14.12.2024 issued by the third respondent and to quash the same as illegal, incompetent and further direct the third respondent to register the Settlement deed, dated 14.12.2024 executed in favour of the petitioner on its presentation. O R D E R

This writ petition has been filed challenging the impugned refusal check slip issued by the third respondent dated 14.12.2024 and for a consequential direction to the third respondent to register the settlement deed dated 14.12.2024 executed by the petitioner's children in favour of the petitioner.

2. Heard Mr.PA.Sudesh Kumar, learned counsel appearing for petitioner and Mr.U.Bharanidharan, learned Additional Government Pleader appearing for respondents.

3. The refusal check slip has been issued by the third respondent mainly on the ground that there is an order of attachment passed by the Execution Court in E.P.No.593 of 1993 in O.S.No.196 of 1992 on the file of Principal District Munsif Court, Tirupathur.

4. In view of the above, this Court called for a report from the concerned Court on 17.03.2025. The report has been received from the 2/4

Principal District Munsif Court, Tirupathur. On going through the report, it is clear that the execution petition itself came to be dismissed for default on 22.07.1996. In the light of the above report, the impugned refusal check slip issued by the third respondent dated 14.12.2024 is hereby quashed and there shall be a direction to the third respondent to register the settlement deed, if it is otherwise in order.
