O R D E R
The Contempt Petition has been filed to punish the respondents for willful disobedience of the order of this Court in W.P.No.30147 of 2023 dated 23.10.2024.
2.When the matter was taken up for hearing today, Mr.A.Muniraj, District Educational Officer (Elementary), Hosur, Krishnagiri District, 1st respondent herein and Mr.B.V.Govindappa, Block Educational Officer, Kelamangalam Block, Hosur Educational District, Krishnagiri District, 2nd respondent herein were present before this Court. The affidavit of the District Educational Officer, Hosur, was filed and the relevant portions are extracted hereunder:
"5.I respectfully submitted that alleging disobedience of order dated 23.10.2024 made in W.P.No.30147 of 2023 petitioner herein have come up with the above contempt petition. I respectfully submitted that pursuant to the orders passed by this Hon'ble Court department have initiated process of reconsidering the proposal for granting approval, pending consideration on the other hand SLP preferred 2/5
by the department regarding the issue of applicability of TET qualifications to the teachers appointed in the Minority School was withdrawn by the government vide order dated 21.02.2025 and the process already initiated by the District Educational Officer (Elementary), Hosur have been proceeded further and granted necessary approval vide proceedings in Na.Ka.No.001385/A4/2023, dated 20.03.2025 and on receipt necessary proposal from the school management bills for disbursing monetary benefits would be processed and disbursed immediately as earlier as possible and thereby orders passed by this Hon'ble Court dated 23.10.2024 made in W.P.No.30147 of 2023 complied in letter and spirit and the delay happened only due to the bonafide reasons stated supra. I respectfully submit that once again I tender my unconditional apology. Hence in the interest of Justice this Hon'ble Court may be pleased to purge us from the above contempt proceedings. Otherwise it will cause grave prejudice and irreparable hardship and heavy loss to petitioner herein."
3.In the light of the above development, the order passed by this Court has been complied with. What remains in this case is the payment of the arrears of salary to the petitioner. There shall be a direction to the 3rd respondent to immediately send the proposal to the 1st respondent. On receipt of the same, the 1st respondent shall pass appropriate orders and arrears of salary shall be paid to the petitioner within a period of six (6) weeks from the date of receipt of the proposal from the 3rd respondent. 3/5
