C.M.P.No.7287, 7288 & 7289 of 2021 in C.M.S.A.No.5 of 2014 P.VELMURUGAN , J., C.M.P.No.7287 of 2021 has been filed to condone the delay of 52 days in filing the petition to set aside the abatement caused due to the death of the first respondent in C.M.S.A.No.5 of 2014.

2. C.M.P.No.7288 of 2021 has been filed to set aside the abatement caused due to the death of the first respondent in C.M.S.A.No.5 of 2014.

3. C.M.P.No.7289 of 2021 has been filed to bring on record the respondents 3 to 5 as the legal representatives of the deceased first respondent.

4. Though the reasons stated in the accompanying affidavit are not satisfactory, this Court is inclined to allow the petitions in the interest of justice and in order to give opportunity to the petitioner to defend the case on merit. Hence, the civil miscellaneous petitions are ordered.

5. Learned counsel for the appellant is directed to file amended memorandum of grounds of appeal on or before 06.10.2023.

6. Registry is directed to amend the cause title in the grounds of appeal and list the matter on 09.10.2023.
