VASUDEVAN [ APPELLANT / ACCUSED ] Vs THE STATE REP BY ITS, [ RESPONDENT ] THE INSPECTOR OF POLICE, SPE: CBI: ACB: CHENNAI, SASTRI BHAVAN, CHENNAI -6 [R.C.MA1/2008(A) 0040)] Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition made pending appeal vide in Crl.M.P.No.10525 of 2017 in Crl.A.No.517 of 2017 dated 24.08.2017 that he shall appear before the said court on the first working day of every month at 10.30 a.m. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.SHANKER, Advocate for the petitioner and of MR.K.

SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P.No.10525 of 2017 in Crl.A.No.517 of 2017 dated 24.08.2017 against the C.C.No.1 of 2010 directing the petitioner to appear before the trial Court on the first working day of every English Calendar month at 10.30 a.m until further orders. 2.The learned counsel for the petitioner would submit that the petitioner is aged and he is not well and has to take care of his wife who is sick and he also has to take care of his child aged about 20 years which is a spastic child and that the child is also obese needing assistance and supported of both parents for his daily needs and thereby, he would seek for relaxation of the said condition.

3.The learned Special Public Prosecutor for CBI Cases would submit that petitioner has been regularly complying with the condition imposed by this Court.

4.Taking into consideration of the submissions made by the counsels on either side, the condition imposed on the petitioner in Crl.M.P.No.10525 of 2017 in Crl.A.No.517 of 2017 dated 24.08.2017 against the C.C.No.1 of 2010 is modified. However, the petitioner shall appear before the trial Court once in three months, on the first working day of the English calender month at 10.30 a.m., commencing from June 2019.
