ORDER

In view of the innocuous relief that is prayed for in the Writ Petition is disposed of at the admission stage. It is made clear that this Court is not expressing any opinion on the merits of the case of the petitioner and since no notice has been issued to the Management, the Management will be entitled to raise all pleas before the second respondent. It is stated that an application under the Tamil Nadu Industrial Establishment (Conferment of Permanent Status to Workmen) Act, is pending before the second respondent. In the interregnum since, the workmen were dismissed they approached the Labour Court and Labour Court has passed an award of reinstating them. Even thereafter, permanency is not confirmed and therefore they want to continue the said application which is pending before the second respondent.

In view thereof, this Writ Petition is disposed of on the following terms:- i)the second respondent shall take up the applications filed by the petitioner dated 13.04.2022 and 09.01.2023 bearing reference Nos. Na.Ka.No.E.1358-B/2022, Na.Ka.No.E.1358-A/2022 and Na.Ka.No.E.1358D/2022 respectively. ii)For enquiry due notice to the petitioner as well as the Management shall be issued. Parties will be entitled to file such pleadings and adduce all evidence before the second respondent.
