O R D E R

The petition has been filed to quash the FIR in crime No.5 of 2015 on the file of the respondent police.

2. The learned Additional Public Prosecutor would submit that the investigation has been completed and the final report has been filed before the learned Chief Judicial Magistrate, Nagapattinam on 20.09.2018 and the trial Court is yet to take cognizance. He would submit that in view of the filing of the final report the prayer of the petitioner has become infructuous and would pray for dismissal of the Criminal Original Petition.

3. At this juncture, the Counsel for the petitioner would submit that the allegation in the complaint relate to the year 2010 and the case has been registered on 12.10.2015 after 5 years and due to this case, the petitioner had been suspended on the verge of his retirement. that due to this case, the petitioner has not received his retirement benefits so far and would seek for a direction to the trial Court to dispose the case within a time frame to be fixed by this Court.

4. In view of the above, the trial Court viz., the learned Chief Judicial magistrate, Nagapattinam is directed to dispose of this case as expeditiously as possible.
