Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records of the second respondent relating to the impugned show cause notice passed in Na.Ka.No.E6/7511/2022 dated 24.06.2024 and to quash the same as illegal and further direct the first respondent to reinstate the job and transfer to Cuddalore or Nagai District or back to the paddy procurement godown (DPC) with full backwages, continuity of service and other benefits to the petitioner. ORDER
The above writ petition has been filed seeking to quash the impugned show cause notice issued by the first respondent on 24.06.2011 in Na.Ka.No.E6/511/2022 and to direct the first respondent to reinstate the petitioner in service and transfer him either to Cuddalore or Nagai District or to the Paddy Procurement Godown (DPC) with full backwages, continuity of service and other benefits etc., 2/6

The petitioner is a native of Vadakumadavilagam Village, Sirkali Taluk, Mayiladuthurai District, who had come down to Chennai on account of his employment in Tamil Nadu Civil Supplies Corporation at Chennai. He had completed his Post Graduation Diploma in Computer Applications. Initially, he was posted as Pattiyal Clerk in Computer Department in Tondiarpet Godown. Thereafter, he was transferred to Parthiban Godown at Redhills, where he served in computer division for one and half years. Later, he was transferred to sales division in Parthiban Godown at Redhills, without any legitimate reasons, where he was made to work day and night for 15 days continuously, and was also put to intolerant abuse by his superior. That part, the petitioner's family was also in a very bad situation and they required the physical care and assistance of the petitioner. Hence, he seeks transfer to Cuddalore or Nagai District or back to the Paddy Procurement Godown (DPC).
3. The petitioner preferred complaints before the Senior Regional Manager and other authorities, challenging his transfer and termination, however no action was taken. Thereafter, he submitted a complaint to Chief Minister's Cell, which led to an enquiry, however the findings are biased, and 3/6
are in favour of the respondents. This had resulted in issuing a show cause notice to the petitioner on 24.06.2024, citing unauthorised absence from work. Hence, the petitioner is before this Court seeking to quash the impugned show cause notice.
4. Heard the learned counsel appearing for the petitioner and Mr.C.Selvaraj, learned Standing Counsel who takes notice on behalf of the respondents.
5. Since the writ petition is filed challenging the show cause notice, this Court is not inclined to entertain a mandamus. That apart, the learned counsel appearing for the respondents on instructions would submit that the petitioner has not submitted his explanation to the impugned show cause notice. In reply, the learned counsel appearing for the petitioner would submit that the petitioner is willing to submit his explanation within a period of one week from the date of receipt of a copy of this order.
6. Accordingly, the writ petition is disposed of. The petitioner shall submit his explanation to the impugned show cause notice within a period of 4/6
