JUDGMENT

(Made by S.S.SUNDAR, J.) This original side appeal is regarding custody of the minor children. The parties have reached a compromise and the parties to the proceedings are present before this Court.

2. The first respondent is no more and the second respondent is present in Court and is represented by counsel. The appellants are also present in Court and they are represented by counsel on record, who in turn is represented by Mr.P.Valliappan, learned Senior Counsel.

3. Learned counsels appearing on either side have produced before this Court a joint memorandum of compromise signed by the parties in the presence of the respective counsel. Learned counsel on either side have agreed that the appeal could be disposed of in terms of joint memorandum of compromise, dated 18.09.2024. Even though the matter is pertaining to custody of the minors, the parties have also reached an agreement in respect of other issues between them.

4. Learned counsel on either side express their consent that in case the parties are required to sign a mediation agreement, they are prepared to enter into a mediation agreement, in terms of the joint memorandum of compromise.

5. In view of the submission of the learned counsel on record and that of Mr.P.Valliappan, learned Senior Counsel, the original side appeal is disposed of in terms of the compromise memo. There will be no order as to costs.

6. The joint compromise memo dated 18.09.2024 shall form part of the record and decree.
