Mr.R.Prathap Kumar Additional Public Prosecutor Prayer : Writ Petition filed under Article 226 of the Constitution of India seeking a writ of Habeas Corpus to call for the records in connection with the order of detention passed by the second respondent on 07.02.2018 in Memo No.61/BCDFGISSSV/2018 against the petitioner's son Saran @ Saranraj, male aged 30 years S/o Purushothaman, who is confined at Central Prison, Puzhal II, Chennai and set aside the same, and direct the respondents to produce the detenu before this Honourable Court and set him at liberty.

O R D E R

(Order of the Court was made by Dr.S.VIMALA, J.) This petition is filed by the mother of the detenu seeking direction to the respondents to produce the detenu Saran @ Saranraj 30 years.

2. Learned Additional Public Prosecutor would bring to the notice of the Court that the detenu was detained under Act 14 of 1982 by the order No.61/BCDFGISSSV/2018 dated 07.02.2018 and was confined to Central Prison, Puzhal. On 20.06.2018, he along with others attacked of one Murali @ Boxer with deadly weapons, in which the said Murali was injured and admitted to the hospital, where he has been declared dead. A case has been registered in M-3 Puzhal Police Station in Cr.No.439/2018 under sections 147,148,324 and 302 IPC against the detenu Saran @ Saranraj and four others.

3. Under the circumstances, this court is of the view that the detenu is not entitled for quashing of the detention order. At this stage, the learned counsel for the petitioner seeks direction to withdraw this petition. Learned counsel has also made an endorsement in the court bundle to that effect.

4. Recording the said statement and the endorsement made by the learned counsel for the petitioner, this H.C.P. is dismissed as withdrawn. No Costs.
