The learned Counsel for the Appellant submitted that the subject matter in the Second Appeal has become infructuous. The learned Counsel appearing for the Respondent would submit that the construction put up on the 16 feet pathway was removed as per the order of this Court. Now, the pathway is existing as 16 feet pathway without any obstruction. 1/3
