PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Certiorarified Mandamus, to call for the records relating to the proceedings of the 1st respondent Vide NA.KA.No.392/2022/02 dated 07.01.2022 and quash the same and also call for the records relating to the proceeding of the 2nd respondent Vide NA.KA.No.798/AA5/2022 dated 04.02.2022 and quash the same consequently direct the 1st respondent here in to forward the petition given by the petitioner dated 14.12.2021 under Maintenance and Welfare of Parents and Senior Citizen Act, 2007 to the 3rd respondent. Mr.C.Jayaprakash, learned Government Advocate accepts notice for the respondents and files a memo dated 01.04.2022 to the effect that the proper procedure to have been followed by https://hcservices.ecourts.gov.in/hcservices/

the District Collector, who has received the complaint of the petitioner, is to forward the same to the Revenue Divisional Officer/R3 in terms of the provisions of the Maintenance and Welfare of Parents and Senior Citizen Act, 2007. However and erroneously, the same has been forwarded to the District Registrar (Administration)/R2 since the subject matter was cancellation of the settlement deed.

2. He would assure the Court that the application of the petitioner dated 14.12.2021 will be forwarded to R3 within 48 hours from today, upon receipt of which R3 will issue notice to the parties and dispose the application in accordance with the aforesaid Act and all other applicable regulations. In light of the order that is passed now, no notice is necessary to R4 at this stage.
