Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, to direct the 2nd respondent to consider petitioner representation dated 11/4/2015 and to not erect a lamp post in the common pathway comprised in Survey No.10/6A and 10/7 Pajanai Koil Street Tambaram Taluk Kanchipuram District South Chennai Registration District. By consent, the writ petition is taken up for final disposal.
2. The petitioner claims that he is the owner of the property situated at Survey No.10/6A and 10/7, Bajanai Koil Street, Tambaram Taluk, Kanchipuram District. According to the petitioner on 07.04.2015, the employees of the 2nd respondent entered into his property for the purpose of erecting the lamp post on the pathway, which is meant exclusively for his access from his house to the main street. The petitioner aggrieved by the action of employees of the 2nd respondent, submitted a representation dated 11.04.2015 to the 2nd respondent. 3. Heard the submissions of Mr.P.Sesubalan Raja, learned counsel appearing for the petitioner and Mr.P.V.Selvakumar, learned standing counsel, who accepts notice for the respondents.
4. Taking into consideration the limited scope of the prayer sought for by the petitioner and without going into the merits of the representation, this Court, directs the 2nd respondent to consider the representation dated 11.04.2015 submitted by the petitioner, on merits and in accordance with law and pass orders as expeditiously as possible and not later than four weeks from the date of receipt of a copy of this order and inform the decision taken, to the petitioner.
