This petition has been filed to modify the condition imposed on the petitioner is directed to deposit a sum of Rs.40,000/- (Rupees forty thousand only) to the credit of Crime No. 299 of 2022 before the concerned Magistrate within a period of two weeks in the above Crl.O.P.No.3391 of 2023 dated 15.02.2023.

2. The learned counsel for the petitioner submitted that as he has no other source of income, he is not able to mobilise the amount to deposit into the credit of crime number as directed by this court. Hence, the present petition has been filed to modify the condition.

3. Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit the sum of Rs.25,000/- (Rupees twenty five 1/3

thousand only) to the credit of Crime No.299 of 2022 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 3391 of 2023 vide order dated 15.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 17.03.2023 rpp 2/3
