This application has been filed to condone the delay of 119 days in representing this Civil Revision Petition.
2. The Civil Revision Petition has been filed against the Order of the District Munsif dismissing the application filed by the petitioner to dispose of the suit without his examination.
3. The suit has been filed by the respondent against the revision petitioner. The only contention of the revision petitioner is that the document relied upon by the plaintiff has already been cancelled by the District Registrar. Therefore, there is no need for examination of the revision petitioner in the suit. Hence, he has filed an application in this regard to dispose of the suit without he being examined. The said application has been dismissed. Challenging the said Order, this present revision has been filed with a delay of 119 days. https://www.mhc.tn.gov.in/judis

4. Despite notice to the respondent, he has not received the notice.
5. Considering the nature of the suit and the lis between the parties and as the respondent is purposely evading notice, this Court holds that their presence is not required in this petition as no adverse Order is likely to be passed against him in the main revision.
6. Accordingly, this Petition is allowed.
