This miscellaneous application has been filed seeking to amend the relief sought to also include certiorari against the order of dismissal which had been passed against the petitioner pending writ petition on 12.09.2019.

It is stated by learned counsel for the petitioner that this fact of dismissal from service had not been communicated to the petitioner and had also not been stated in the counter affidavit filed by the second respondent but signed on 28.10.2019. 3.

At any rate, it is a fact that the petitioner had been dismissed from service.

This writ petition has been filed questioning the suspension, questioning the charge memo issued and questioning the enquiry report. Now, therefore, this application has been filed since a consequential order had been passed. It would only be appropriate that the petitioner is also granted opportunity to advance arguments including on the suspension, also the charge memo, also on the enquiry report and now also on the issue of dismissal from service.

In view of that particular fact, this application has been allowed.

Time is granted for filing counter affidavit consequent to amendment application being allowed.
