ORDER

The petitioner has come forward with this contempt petition stating that the respondent has willfully disobeyed the order passed by this Court dated 22.02.2016, made in Crl.O.P.No.3759 of 2016

namely, not filing the final report within the time stipulated viz., three months from the date of receipt of a copy of this order. 2.Today, when the matter was called no one represented on behalf of the petitioner. However, the respondent / contemnor is present and he also filed his counter stating that the delay in filing the charge sheet has occurred only because of the need to obtain sanction from the Government, since the charge sheet has been leveled for the offence punishable under Sections 12(1)(b) of Indian Passport Act, u/s.468, 471, 420 I.P.C. Further, the respondent also tendered his unconditional apology. Furthermore, now the charge sheet has been filed which was taken on file as C.C.No.4229 of 2016 on the file of the XXIII Metropolitan Magistrate.

3. Accepting the unconditional apology and also recording the submission that already the charge sheet has been filed and the same was taken on file as C.C.No.4229 of 2016 on the file of the XXIII Metropolitan Magistrate, this petition is disposed of. 06.10.2016
