2. Mr.C.A.Diwakar, learned counsel for the petitioner submits that trial is

on-going in the suit, which has been transferred to the City Civil Court and hence nothing further survives in this Miscellaneous Petition.

3. Recording the aforesaid submission, the Miscellaneous Petition is closed. No costs.
