ORDER

This Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondent to grant up-gradation of Engine/Boat Driver (Special Grade) in the scale pay of Rs.9300-34,800/- with grade pay of Rs.4200/- with effect from the date of eligibility of the petitioner with arrears of pay and all other consequential benefits.

2. Heard Ms.S.Meenakshi, learned counsel for the petitioner and Mr.R.Sridhar, learned Additional Government Pleader for the respondent.

The petitioner joined the service of the respondent Corporation in the year 1991 as Boat Driver on contract basis and later he got regularised and finally promoted to Boat Driver Grade-I in the year 2006. But thereafter, he was not given any further promotion though he served in the capacity of Boat Driver Grade-I for nearly 15 years. The petitioner has not been given with the selection grade or special grade as well. As per the assured career progression scheme, the employee is entitled to next higher scale of pay and grade pay that is applicable to the next promotion category.

4. The learned counsel for the petitioner submitted that the petitioner's batchmates have been given with selection grade and their pay has been revised. The same benefit is not extended to the petitioner.

Since the petitioner is also similarly placed as that of his batchmates whose designation has been re-designated as Manager Grade I & II and their pay has been revised, the petitioner is also entitled to get similar treatment from the respondent. Since the petitioner's representation in this regard has not been considered so far and the pay has not been revised with due up-gradation, the respondent is directed to consider the representation of the petitioner and pass appropriate orders.

In the result, this Writ Petition is disposed and the respondent is directed to consider the representation of the petitioner in accordance with law and pass appropriate orders within a period of six weeks from the date of receipt of a copy of this order.
