JUDGMENT

[Delivered by M.M.SUNDRESH, J.] On the last occasion i.e., 16.09.2019, the following order was passed:- The matter has been adjourned on the last three occasions at the request of the learned counsel for the appellant. On the last occasion, https://hcservices.ecourts.gov.in/hcservices/

since there was no representation on behalf of the appellant, the matter was directed to be listed on 16.09.2019 under the caption 'for dismissal'. Even today, learned counsel for the appellant submits that there is no instruction forthcoming and therefore seeks some more accommodation. We also note that the judgment has been rendered by the trial Court way back in January, 2010 and the case itself has been taken on file in S.C.No.450 of 2006. After the acquittal, now more than 9 1/2 years is over. Though we are not inclined to grant adjournment, considering the fervent plea of learned counsel for the appellant, the matter is directed to be listed on 23.09.2019.

Post the matter on 23.09.2019.

2.Today, the learned counsel who filed the memo for the appellant has submitted that no instruction is forthcoming despite due intimation given. Thus, inasmuch as the intimation has already been stated to have been given, we can only presume that the appellant is not interested in pursuing the matter. Therefore, in the light of the order referred above, this criminal appeal stands dismissed.
