Mr. DR.G.Babu, CGSPC For R1 & R2 Order These writ petitions have been filed to direct the second respondent to consider the petitioner's representation dated 27.01.2026, requesting the second respondent to dispose of the petitioner's petition dated 24.10.2025, filed under the provisions of the Micro, Small and Medium Enterprises Development Act, 2006.

2.The petitioner is the supplier and the third respondent is the purchaser. The petitioner has a claim against the third respondent in respect of the supplies effected by the petitioner to the third respondent for the unpaid invoices. The petitioner claims that they are registered under the provisions of the Micro, Small and Medium Enterprises Development Act, 2006.

3.The petitioner had submitted a petition dated 24.10.2025 with the second respondent under the provisions of the said Act seeking for recovery of the dues payable by the third respondent. Thereafter, the petitioner also submitted a representation dated 27.01.2026 to the second respondent requesting them to register the petitioner's petition filed under the provisions of the said Act and proceed further in accordance with law against the third respondent. Since the representation of the petitioner dated 27.01.2026 has not been considered, the petitioner has filed these writ petitions. 4.Dr.G.Babu, learned Central Government Standing Counsel accepts notice on behalf of respondents 1 and 2.

5.No prejudice would be caused to the respondents if a direction is issued to the second respondent to consider the petitioner's representation dated 27.01.2026 seeking to dispose of the petition filed by the petitioner on 24.10.2025 against the third respondent under the provisions of the Micro, Small and Medium Enterprises Development Act, 2006, on merits and in accordance with law, after hearing the objections of the third respondent, within a time frame to be fixed by this Court.

6.This Court is not expressing any opinion on the merits of the petitioner's representation.

7.For the foregoing reasons, these writ petitions are disposed of by directing the second respondent to pass final orders, on merits and in accordance with law on the petitioner's petition dated 24.10.2025, filed under the provisions of the Micro, Small and Medium Enterprises Development Act, 2006 against the third respondent, after hearing the objections of the third respondent and by adhering to the principles of natural justice, within a period of six months from the date of receipt of a copy of this order.
