ORDER

The applicant had filed OSA(CAD) No.148 of 2024 challenging order dated 25.03.2024 in Arb.O.P.(Comm.Div.) No.263 of 2023. The appeal was disposed of in terms of memorandum of compromise dated 13.12.2024. The entire memorandum of compromise has been scanned and reproduced in the appellate order. As per paragraph 6(a), the appellant / applicant herein agreed to pay a sum of Rs.22,00,000/- as full and final settlement. As per paragraph 6(e), the order of attachment issued on 15.04.2019 in O.A.No.113 of 2018 was agreed to be raised within four weeks from the appellant making full payment as per the memorandum of compromise.

2. The applicant has filed evidence of payment of the agreed sum of Rs.22,00,000/- in full and final settlement. Communication dated 09.08.2025 from counsel for the applicant to counsel for the respondent sets out details of such payment and encloses copies of the payment instruments. The respondent is present in person.

3. Since the applicant has paid the entire amount agreed to be paid as per the memorandum of compromise, the order of attachment in respect of the property situated at Survey No.6/3 part and 6/9, Ramapuram Village, measuring an extent of 2106 sq.ft with building thereon bearing address No.3/10A, Raghavendra Nagar, 3rd Street, near Nesapakkam, Ramapuram, Chennai 600

089 is hereby raised. A copy of this order shall be communicated to the Sub Registrar, South Joint-II, Saidapet, Chennai for purposes of making neutralizing entries in the register of encumbrances. These applications are disposed of on these terms without any order as to costs.
