Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the entire records relating to the impugned order passed by the first respondent in his proceedings Na.Ka.88106/2011 Sa.Pa1, dated 14.03.2012 whereby confirming the order passed by the second respondent in his proceedings Na.Ka.8416/2006 Sa.Pa, dated 23.08.2010 and quash the same and consequently direct the respondents to reinstate the petitioner into service with all attendant benefits, backwages and monetary benefits.

ORDER

When the Writ Petition was listed today, after being adjourned from 04.06.2026 for the learned counsel for petitioner to get instructions in the matter, the learned counsel for the petitioner submitted that despite he trying to contact the petitioner to inform about the pendency of the case, he could do so and neither the petitioner kept in touch with the her nor provided any instructions to her.

2. Thus, the learned counsel for the petitioner submitted that in the absence of any instructions, she cannot make submissions in the matter.

In view of the aforesaid submissions made by the learned counsel for the petitioner, since the present Writ Petition has been filed in the year 2010 and counsel for the petitioner having expressed her inability to proceed with the matter in the absence of petitioner turning up for providing instructions, this Court is of the view that no useful purpose would be served in keeping the present Writ Petition pending on the file of this Court, as the petitioner has not been diligent in pursuing the matter.

4. Accordingly, the Writ Petition is dismissed for non- prosecution. No costs. Consequently, connected Miscellaneous Petition is closed. 05.06.2026 Index : Yes/No Speaking order : Yes/No dna 3/5
