This petition has been filed to permit the petitioner/petitioner to withdraw the deposited amount Rs.5,00,000/- to the credit of Crime No.963 of 2011 lying in the Court of learned Judicial Magistrate, Thiruvotriur as per order passed in Crl.No.502 of 2012 dated 25.01.2012.

2. The petitioner filed an application for anticipatory bail before this Court in Crl.O.P.No.502 of 2012. This Court granted anticipatory bail to the petitioner on 25.01.2012 on condition that the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs only) to the credit of Crime No.963 of 2011 before the learned Judicial Magistrate, Thiruvottiyur.

3. The petitioner had duly complied with the condition and he was enlarged on bail. Subsequently, the respondent completed the investigation in Crime No.963 of 2011 and referred as "Further Action Dropped" on 14.12.2011.

4. Now, the entire amount is lying in the credit of Crime No.963 of 2011 on the file of the learned Judicial Magistrate, Thiruvottiyur.

5. The learned counsel for the petitioner would submit that the FIR in Crime No.963 of 2011 has been transferred from the learned Judicial Magistrate, Thiruvottiyur to the learned Judicial Magistrate, Madhavaram. https://www.mhc.tn.gov.in/judis

Considering the above facts and circumstances of the case, the petitioner is permitted to withdraw the amount which was deposited by him to the tune of Rs.5,00,000/- (Rupees Five Lakhs only) on the credit of Crime No.963 of 2011, by filing a proper application before the learned Judicial Magistrate, Madhavaram.

7. In view of the above, this Criminal Miscellaneous Petition stands allowed.
