The petitioner was convicted for offence under Sections 7 and 13(2) r/w Section 13(1)(d) of the Prevention of Corruption Act, 1988 vide judgment dated 10.07.2023 in Spl.C.C.No.6 of 2012 on the file of the Chief Judicial Magistrate/Special Judge, Thiruvallur. 2.

Earlier this Court refused to grant bail and dismissed the application filed for suspension of sentence. Thereafter, the petitioner moved this Court seeking interim bail for a short period to take care of his mentally challenged son. Hence the interim suspension of sentence for a period of three months was granted vide order dated 19.12.2023. On expiry of 90 days, the petitioner had surrendered before the prison authority and presently he is in prison. He has moved application for suspension of sentence, since the appeal is pending for more than one year and may not be taken up for final disposal within near future.

Considering the above submission and his conduct, the petition is allowed. The substantive sentences of imprisonment alone is suspended and the petitioner is directed to be enlarged on bail on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- [Rupees One lakh only] with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate/Special Judge, Thiruvallur and on further condition that the petitioner shall appear before the said Court on the first working day of every English Calendar Month at 10.30 a.m. until further orders.
