ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1), 109(1), 351(3) of BNS in Crime No.80 of 2026, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that due to previous enmity between the defacto complainant and the petitioner, there was a wordy quarrel in which the petitioner along with other accused abused the defacto complainant in filthy language and also assaulted the defacto complainant. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that there is no previous case against the petitioner and hence, he opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Though the defacto complainant was discharged from the hospital, considering the severe injury sustained by the defacto complainant with the weapon used in the occurrence, this Court is of the view that the petitioner does not deserve anticipatory bail.
