Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a writ of mandamus, directing the respondents to disburse the payments the petitioner is entitled to after deducting the sum of Rs.14,00,000/- already disbursed. For Petitioner : Mr.S.Mukunth for M/s.Sarvabhauman Associates.

For Respondents : Mr.R.Vijayakumar (for R1) Additional Government Pleader.

By consent, the writ petition is taken up for final disposal.

2. The petitioner would state that his father is a Contractor and was engaged in the business of road laying and also a registered Contractor under the 2nd respondent.

3. The petitioner would further state that the 2nd respondent floated a tender for road laying work from Nekkini to Amirdhi passing through Poosanavalasai forest area and though his father completed 90% of the work satisfactorily and that after his demise, the petitioner being an Associate, continued the work and completed the same, payment due and payable in respect of the work undertaken has not been paid. Hence, the petitioner, in this regard submitted a representation dated 30.03.2015 to the 2nd respondent and since, he has not been favoured with any response came forward to file this writ petition.

4. Learned counsel for the petitioner would submit that the father of the petitioner died on 16.01.2015 and since the work entrusted has been successfully completed, as a matter of right, the petitioner is entitled to get the payment and prays for appropriate orders.

5. The Court heard the submissions of Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice for the 1st respondent and Mr.M.K.Subramanian, learned Special Government Pleader (Forest), who accepts notice for the 2nd respondent.

6. Though, the petitioner has sought for a larger relief, this Court, without going into the merits of the representation, directs the 2nd respondent to consider the representation dated 30.03.2015 submitted by the petitioner, on merits and in accordance with law and pass orders as expeditiously as possible and not later than eight weeks from the date of receipt of a copy of this order and inform the decision taken, to the petitioner.

7. The writ petition is disposed of, accordingly. No costs.
