ORDER

After some arguments, when this Court not inclined to entertain this petition, the learned counsel for petitioner sought permission of this Court to withdraw this petition. He has also made an endorsement in the petition to that effect.

2.The primary contention of the learned counsel for petitioner is with regard to Ex.D2 (Original F.I.R.) and Ex.P23 (Corrected F.I.R.), particularly the discrepancy in the timing of receipt of information and the registration of F.I.R. sent to the Court. Since there is violation, he already filed a petition under Section 340 Cr.P.C. in Crl.M.P.No.5 of 2026 before the trial Court, which is yet to be decided, which would go to the root of the case. 3.Since this Court is not inclined to entertain the present petition, the learned counsel submitted that the petitioner may be permitted to advance his arguments on 04.03.2026 before the trial Court in Spl.C.No.4 of 2021 as well as in Crl.M.P.No.5 of 2026. The Trial Court shall proceed with the case on 04.03.2026 or any other day thereafter.
