ORDER

This Criminal Original Petition has been filed to call for the records and quash the FIR and other proceedings in Crime No.1 of 2015, pending on the file of the Inspector of Police, R.4, Pondy Bazaar Police Station, Chennai.

On the complaint lodged by one P. Ramaswamy, Assistant Manager, HDFC Bank, the respondent police registered a case in Cr. No.1 of 2005 on 01.01.2005 under Section 420 read with Section 511 read with Section 34 IPC, against Selven Ram @ Selvam and 4 others, challenging which, Selven Ram @ Selvam has preferred this Criminal Original Petition.

On a reading of the complaint dated 01.01.2005 which forms the basis for registration of the FIR, it appears that the accused had given fake international credit card and they were caught red handed with the bogus credit card and handed over to the police.

Thus, since there are prima facie materials for a fullfledged investigation to proceed, this Court is of the considered view that this is not a fit case to quash the https://hcservices.ecourts.gov.in/hcservices/

prosecution at the threshold, in the light of the law laid down by the Supreme Court in State of Haryana and others vs. Bhajan Lal and others [1992 Supp (1) SCC 335].
