ORDER

In a proposed suit for recovery of container detention charges and for the value of two unreturned containers, the intending plaintiff seeks leave to sue the respondent before this Court. In the draft plaint, it is stated that the containers were discharged at the Chennai Port and that they were taken to the first defendant's factory for de-stuffing. It is also stated that the subject containers were discharged at the Chennai container terminal.

2. Upon considering the above averments, I find that at least a part of the cause of action has arisen within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondent before this Court. As a consequence, the Registry is directed to number the suit, if otherwise in order.
