ORDER

The petitioner who was arrested and remanded to judicial custody on 04.01.2026 for the offence punishable under Sections 117(2) of BNSS 2023 r/w Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 1998 which was subsequently altered to Section 109 of BNSS 2023 in Crime No.05 of 2026 registered on the file of respondent police seeks bail.

2. The case of the prosecution is that the petitioner herein fell in love with the victim girl and thereafter the victim girl refused to marry her. It is alleged that on the date of occurrence when the victim girl was in terrace the petitioner also came there and pushed the victim girl, due to which the victim sustained grievous injuries and she is still under treatment. Hence, the case.

The learned counsel for the petitioner submitted that there was a love affair between the petitioner and the victim girl for the past 5 years and thereafter due to some difference of opinion they were separated. He further submitted that the victim girl jumped from the terrace and the petitioner has not pushed her. He also submitted that the petitioner is in Judicial custody from 04.01.2026 and is ready to co-operate with the investigation and abide by any stringent conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate reiterated the prosecution case and submitted that in the statement recorded under Section 183 of BNSS 2023 the victim girl has categorically stated that the petitioner has pushed 2/4

her from the terrace and the victim is still taking treatment. Hence, he opposed to grant bail to the petitioner.

5. Considering the submissions made by the learned Government Advocate and the manner in which the occurrence has taken place and the victim is still under treatment, this Court is not inclined to grant bail to the petitioner.
