ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable unde Sections 294(b), 323 and 506(i) of IPC, in Crime No.32 of 2022 seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is working as security, attacked the defacto complainant who is also working as security in the adjacent jewellery shop. Due to altercation, caused some dispute regarding the parking of vehicle. Though it appears that the petitioner has attacked the defacto complainant with hands and caused injury like nasal bleeding and sustained fracture in the left arm indicates that the petitioner has attacked the defacto complainant ferociously causing grievous injury. Hence the complaint.
3. The learned counsel for the petitioner submits that the petitioner is aged about 64 years and the complaint was lodged only after three days from the date of occurrence. However, the occurrence took place on 07.02.2022 and CSR has been registered https://hcservices.ecourts.gov.in/hcservices/
immediately and later an FIR has been registered after three days. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl.Side) submits that the petitioner having caused grievous injury to the defacto complainant including fracture in the fore arm and the petitioner is absconding. Hence, he opposed to grant anticipatory bail to the petitioner.
5. Considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioner.
