Respondents Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of Mandamus, directing the respondents herein to forthwith settle the arrears of 6th pay commission of Rs.23,282/- together with interest at the rate of 24% per annum with effect from 18.02.2005 till the date of realization to the petitioner herein. ORDER

Though this writ petition has been filed for grant of 6th Pay Commission Benefits to the petitioner, however, it is brought to the notice of this Court that pending the writ petition, the petitioner has been granted the relief of 6th Pay https://hcservices.ecourts.gov.in/hcservices/

Commission Benefits and arrears have also been disbursed to the petitioner along with interest at 3% p.a.

However, learned counsel appearing for the petitioner submits that the belated payment of the 6th Pay Commission arrears to the petitioner should entail payment of atleast interest at 12% p.a. However, this Court is not inclined to accept the said submission, as the respondents, of their own volition, have paid 3% interest. In the facts and circumstances of the case, taking a holistic view of the entire issue, this Court is not inclined to accede to increase the interest. In the above circumstances, recording the submission that the relief sought for has been granted to the petitioner, nothing survives for further adjudication in this case. Accordingly this writ petition is closed. However, there shall be no order as to costs.
