Venkata Prakash by considering the certified copies of the antecedent title deeds i.e., Document Nos.573/1974 and 574/1974 of respondent's office for the properties in Survey No. 394/1A situate in Idigarai Village, Annur taluk, Coimbatore District.

ORDER

This writ petition has been filed challenging the refusal check slip issued by the respondent dated 17.12.2024 and for a consequential direction to the respondent to register the Release Deed executed by the petitioner in favour of her son.

2.Heard Mr.V.M.Venkatraman, learned counsel appearing on behalf of the petitioner and Mr.K.Karthick Jagannath, learned Government Advocate appearing on behalf of the respondent.

3.The refusal check slip has been issued by the respondent only on the ground that the original title document was not produced at the time of registration. The learned counsel for the petitioner submitted that the original documents were misplaced and lost even during the lifetime of the husband. An

3/5 averment to that effect has been made at Paragraph No.4 of the affidavit filed in support of the writ petition.

4.It is left open to the petitioner to add a recital in the Release Deed by assigning reasons for the non-availability of the original title document and in that event, there shall be a direction to the register the document, if it is otherwise in order.

5.In the result, this writ petition stands allowed with the above direction. No Costs.
